Terms of Service
The rules for using this website, and the terms we work on, written to be read.
Last updated: September 27, 2026
The short version
- This site describes our work and the terms we work on. What binds both sides is the agreement you sign.
- Prices here are starting points. Your price is the fixed price in your signed agreement.
- Every promise on our How We Work page goes into your written agreement. Our standard agreement carries them.
- Nothing on this site is legal, tax or financial advice.
- What you send us through a form stays yours, and what you tell us about your business stays confidential.
- You're welcome to read, print and share our pages. Please don't copy them as your own.
This short version is a guide. The full terms below are what count.
Who we are and what these terms cover
This website, exceptionalweb.com, is run by Exceptional Web LLC, a Nevada limited liability company. "We", "us" and "our" mean Exceptional Web LLC.
These terms cover your use of the website: its pages, the self-checks and the forms. By using the site, you agree to them. If you don't agree, please don't use the site.
The site is meant for business use, by people 18 or older.
Our Privacy Policy explains what we collect when you use the site and what we do with it. Please read it too.
Work you hire us for has its own agreement
These terms don't govern any project. Any work you hire us for has its own written agreement, signed by both sides. It sets the scope, price, timing, payment, ownership and guarantees.
"Signed" includes an electronic signature.
Using this site, sending a form or booking a conversation doesn't make you a client. It doesn't commit you, or us, to any work.
If anything on this website differs from your signed agreement, the agreement wins.
Prices and timing on this site
Prices on this site ("from" prices and price bands) show where work usually starts. They aren't offers you can accept by clicking, booking or replying.
Within two business days of the conversation, you get your game plan in writing, with a fixed price for the work. That price binds both sides once it's in an agreement you've both signed.
Delivery times on this site, like "4 business days", describe typical work. Your agreement sets your timeline.
Badges and headlines are short summaries. The full wording is on How We Work and the package's own page, and in your agreement.
We may change prices, packages and descriptions on the site at any time. A change never affects an agreement already signed.
What our standard agreement says
Every promise on our How We Work page goes into your written agreement. Here, in short, is what our standard agreement says.
A fixed price for a defined result, agreed before we start. Never billed by the hour.
No discounts. If the budget is tight, we suggest a smaller scope.
Larger packages are paid in milestones, so you never pay for work you haven't seen. Your game plan lists them.
Where a package page says so, you can stop after milestone one. You pay for that milestone only, and keep what it delivered.
If the scope needs to change, we say so before doing anything extra. New scope gets a new fixed price, agreed by you first.
Fixed if it's ours. If something we built doesn't work the way we said, we fix it. No invoice.
"The way we said" means the finish line written into your agreement before we start.
Changes made by others (your developer, another agency, a new app) and platform updates are new work. On AI work, AI model and tool updates count as platform updates.
If that happens, you hear what changed, and get a price, before anyone touches it.
Go ahead with the next package within 30 days and the first fee counts toward it, so you don't pay for the same work twice. Only these pairs qualify:
Tracking Audit, toward the Tracking Audit & Repair Sprint or Measurement Foundation.
Consent & Privacy Tracking Check, toward our fixes (up to their price) or Measurement Foundation.
Data Collection Plan, toward Measurement Foundation.
Operations Map, toward the Operating System for One Program.
AI Team Workshop, toward a Governed AI Workflow.
AI Opportunity Map, toward a Governed AI Workflow.
No other package earns a credit.
Month to month, with 30 days' notice.
The first 90 days are one block. After that it's month to month, with 30 days' notice.
We work inside your accounts, never ours. Everything we build is yours once paid for. You remove our access when we're done.
Our own methods and templates stay ours. What we build with them is yours.
If part of the work needs a developer or designer, you hire and pay them directly, in your name. We help pick and brief them. No markup.
Running costs, if any, are paid directly to the provider, in your name. You get the number before we start.
What you tell us about your business stays confidential, before and after you sign.
If you'd like, part of the fee can ride on a result we control. Agreed in writing before we start.
Some packages add a promise of their own, like keeping at it until the numbers agree. It's on that package's page, and it goes into that package's agreement too.
If a promise you read on this site isn't in your agreement, tell us before you sign. It should be there.
Information, not advice
Everything on this site is general information about marketing, tracking, analytics, operations and AI. It isn't advice for your specific situation.
That includes the Five Checks and Five Questions pages. They're self-checks. A score there is where a conversation starts. It doesn't diagnose your business.
Our written reply to your answers is based only on what you told us. We haven't seen your accounts, so treat it as a pointer until we have.
Pages about consent, privacy and pixels, including the Consent & Privacy Tracking Check, describe technical facts. They aren't legal advice.
Whether a law applies to you, and what it requires, is a question for your lawyer. We're glad to brief them on the technical side.
Client stories are real and anonymized. Where a figure is projected rather than measured, the page says so.
Testimonials are quoted word for word. When we shorten one, we leave out whole sentences and never change words inside a sentence.
Examples marked "illustrative" show the shape of our work. They aren't a real client's data.
Results depend on each business. A story shows what happened for someone else. It doesn't promise the same for you.
What you send us
When you use a form or send us your answers, you're responsible for what you send. Please make sure it's accurate and that you're allowed to share it.
Please don't send passwords, logins or your customers' personal data through a form.
If a project needs access, you add us as a user in your own accounts, with only the access the work needs.
What you send stays yours. You give us permission to use it to reply to you and to prepare for a conversation. We keep what you tell us about your business confidential.
Our Privacy Policy covers how we store it and how long we keep it.
Our content and how you can use it
The words, checklists, examples, designs and graphics on this site belong to Exceptional Web LLC, or to others who let us use them. Copyright and other laws protect them.
You may read, print, bookmark and share links to any page. You may use the self-checks for your own business and share them with your staff, agency or developer.
Please don't copy, republish or sell our content, or present it as your own, without our written permission. Short quotes with a link back are fine.
"Exceptional Web" and our logo are ours. Other names on the site, like Shopify, Google, GA4 and Meta, belong to their owners.
Naming them doesn't mean they endorse us, or that we endorse them.
Using the site fairly
When you use this site, please don't:
- Break any law, or use the site to harm anyone.
- Try to get into parts of the site, our systems or our accounts that aren't public.
- Send malware, spam or anything designed to disrupt the site or its forms.
- Scrape or copy the site in bulk, including to train software, without our written permission.
- Pretend to be someone else, or send us information about people you don't have the right to share.
If someone breaks these rules, we may block their access to the site.
Links to other sites
Some pages link to other websites, like platform help pages or booking and form tools. We don't control those sites and aren't responsible for their content or their privacy practices.
A link is there because we think it's useful. It isn't an endorsement. Their own terms apply when you use them.
Disclaimers
We work to keep this site accurate and current. Platforms like Shopify, GA4 and Meta change often, though, and a page can fall behind before we update it.
So the site and everything on it is provided "as is" and "as available".
To the extent the law allows, we make no warranties about the website, express or implied, including accuracy, merchantability, fitness for a particular purpose and non-infringement.
We don't promise the site will always be available, error-free or free of viruses.
This section is about the website only. Promises about work you hire us for, including the workmanship guarantee, are in your signed agreement.
Limitation of liability
To the extent the law allows, Exceptional Web LLC and the people who work for it aren't liable for indirect, incidental, special or consequential losses that come from your use of this site.
That includes lost profits, lost revenue and lost data.
Some places don't allow these limits. Where that's the case, they apply as far as the law allows.
This section covers the website only. Liability for paid work is set in your signed agreement.
If a claim comes from your misuse
If you misuse the site or break these terms, and that leads to a claim against us, you agree to cover our reasonable costs and losses from that claim, including legal fees.
Governing law, changes and the small print
These terms are governed by the laws of the State of Texas, without regard to its conflict of law rules.
Any dispute about this website will be decided in the state or federal courts located in Williamson County, Texas, and both sides agree to those courts.
We may update these terms. When we do, we'll change the date at the top. The terms in place when you use the site are the ones that apply. Ask and we'll send an earlier version.
If a court finds part of these terms unenforceable, the rest still applies. If we don't enforce a term right away, we haven't given it up.
These terms are the whole agreement about your use of this website. Your signed agreement governs any work.
